1. Scope of Application These General Terms and Conditions apply to all orders placed through our online shop. Our online shop is intended exclusively for consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity. A business is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of its commercial or independent professional activity. 2. Contractual Partner, Conclusion of Contract The purchase contract is concluded with Swissmondue-shop.com. The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the ordering process. By clicking the order button, you submit a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order will be sent by email immediately after you submit it. When the contract with us is concluded depends on your chosen payment method: Credit card: By submitting your order, you simultaneously transmit your credit card details to us. After verifying your identity as the legitimate cardholder, we request your credit card company to initiate the payment transaction and thereby accept your offer. PayPal, PayPal Express: During the ordering process, you will be redirected to the PayPal website. There, you can enter your payment details and confirm the payment instruction to PayPal. After you submit your order in our shop, we request PayPal to initiate the payment transaction and thereby accept your offer. Sofort by Klarna: After submitting your order, you will be redirected to the Sofort website, where you confirm the payment instruction. This concludes the contract with us. Amazon Pay: During the ordering process, even before completing the order in our online shop, you will be redirected to the Amazon website. There, you can select the delivery address and payment method stored with Amazon and confirm the payment instruction to Amazon. You will then be redirected to our online shop, where you can complete your order. After you submit your order, we will request Amazon to initiate the payment transaction, thereby accepting your offer. 3. Contract Language, Contract Text Storage The language available for concluding the contract is German. We will store the contract text and send you the order details and our Terms and Conditions by email. You can view the contract text in your customer login. 4. Delivery Conditions / Shipping Deliveries are possible to delivery addresses within Germany, Austria, France, Italy, the Netherlands, Belgium, Poland, Switzerland, and Liechtenstein. Shipping to Germany is free for orders over CHF 100 and is climate-friendly thanks to DHL GoGreen. Shipping to Austria, France, Italy, Belgium, or the Netherlands is free for orders over CHF 100. Orders are delivered exclusively via shipping. In the event of reshipment due to an incorrect address provided by the buyer, we reserve the right to subsequently charge the shipping fee. The fee is CHF 3.00 / CHF 6.00. It is the buyer's responsibility to check all information before completing the order process. 5. Payment The following payment methods are generally available in our shop: Credit Card When you place your order, you simultaneously transmit your credit card details to us. After verifying your identity as the legitimate cardholder, we will request your credit card company to initiate the payment transaction immediately after you place your order. The payment transaction is processed automatically by the credit card company, and your card will be charged. PayPal, PayPal Express During the order process, you will be redirected to the PayPal website. To pay the invoice amount via PayPal, you must be registered with PayPal or register first, authenticate yourself with your login details, and confirm the payment instruction to us. After you place your order in our shop, we will request PayPal to initiate the payment transaction. The payment transaction will then be processed automatically by PayPal. You will receive further information during the order process. Sofort After placing your order, you will be redirected to the website of the online payment provider Sofort GmbH. To pay the invoice amount via Sofort (instant bank transfer), you must have an online banking account with PIN/TAN authentication enabled for Sofort, authenticate yourself accordingly, and confirm the payment instruction to us. You will receive further instructions during the ordering process. The payment transaction will then be processed immediately by Sofort, and your account will be debited. Amazon Pay: During the ordering process, you will be redirected to the Amazon website before completing your order in our online shop. To process your order and pay the invoice amount via Amazon, you must be registered there or register first and authenticate yourself with your login details. There, you can select your saved delivery address and payment method, confirm Amazon's use of your data, and confirm the payment instruction to us. You will then be redirected back to our online shop, where you can complete your order. Immediately after you place your order, we will request Amazon to initiate the payment transaction. The payment transaction will be processed automatically by Amazon. You will receive further instructions during the ordering process. 6. Retention of Title: The goods remain our property until full payment has been received. 7. Transport Damage : If goods are delivered with obvious transport damage, please report such damage immediately to the delivery driver and contact us without delay. Failure to report damage or contact us will not affect your statutory rights or their enforcement, in particular your warranty rights. However, your cooperation helps us to assert our own claims against the carrier or transport insurance company. 8. Warranty and Guarantees : The statutory warranty rights apply. For used goods: If the defect occurs after one year from delivery of the goods, claims for defects are excluded. Defects that occur within one year of delivery of the goods can be asserted within the statutory limitation period of two years from delivery of the goods. 9. Statutory Right of Withdrawal: Information on the statutory right of withdrawal. The statutory right of withdrawal is mandatory for both parties. This right takes precedence and is valid for 14 working days from the date of delivery. 9.1 Incorrectly Sent Returns We are not liable for the loss, destruction, depreciation, or damage of incorrectly sent returns that are not our products, regardless of the legal basis. 10. Contractual Right of Return In addition to the statutory right of withdrawal for consumers and users according to clause 9 above, we grant you a contractual right of return. The right of return applies to all items purchased via the (swissmondue-shop) online shop. This applies to all products unless otherwise indicated. For products purchased via marketplaces other than the Snocks online shop www.swissmondue-shop.com , the respective terms and conditions of the respective provider apply. The products may be tried on but should be returned to us in new condition (e.g., not worn for an extended period). For returns, we charge a flat shipping fee of CHF 6.90 within Germany, €5.90 from Austria, €5.90 from France, Italy, Belgium, or the Netherlands, 29 zł from Poland, or CHF 6 from Liechtenstein, which will be deducted from your refund. The corresponding form can be accessed under Help & Contact . Our extended return period is 14 days and begins on the order date . Please note that we cannot process returns received after 21 days from the order date. A refund is not possible in this case. For returns sent back to us more than 100 days after the order date, the products will be donated to a charitable organization (e.g., aid in Mongolia). Returns sent to our office or warehouse address at your own expense after 100 days cannot be processed. A refund is not possible. 10.1 Return of Complete Orders For orders with a total value exceeding CHF 150.00, placed more than 30 days ago, and returned in full, Swissmondue reserves the right to issue a voucher for the full purchase price instead of a refund. This voucher is valid for three years from the end of the calendar year following its issuance. Exceptions may apply. If an order with a merchandise value exceeding CHF 39.00 is returned to us in full after the statutory cancellation period has expired, Swissmondue reserves the right to retain a flat shipping fee of CHF 6.90. The amount of the respective order, less the flat fee, will be refunded to the specified payment method within 14 business days. 10.2 Claims for Gifted Items: If a second owner wishes to return an item within our 21-day return period from the date of purchase, the complete details of the original owner/buyer (name, address, email address, and order number) must be provided. In this case, the refund will be issued via the original payment method. If a return is made to the seller without the details of the original owner/buyer, processing the return is not possible. The goods will be donated. A refund to the requesting party is not possible. 10.3 Incorrectly Sent Returns: We are not liable for the loss, destruction, depreciation, or damage of incorrectly sent returns that are not our products, regardless of the legal basis. 11. Undeliverable Delivery: If your order cannot be delivered after several attempts for reasons beyond our control, it will be returned to us. In this case, we assume that you wish to withdraw from the contract, which then automatically converts into a restitutionary obligation. As a consequence, we will promptly refund all payments received from you, excluding shipping costs (with the exception of additional costs resulting from your choice of a shipping method other than our standard shipping option), but no later than 14 days after withdrawal. 11. Discounts, Discount Codes & Gift Cards 11.1 Discounts & Discount Codes Usability Each discount code can only be used once per purchase and per customer. Only one discount code can be used per order. Combining different discount codes is not possible. Combining bundles and discount codes is not possible. If a discount code is applied to an already reduced offer price (larger packaging unit/bundle), the discount will be deducted from the individual price. Cash payment of discount codes is not possible, nor is any other offsetting or refund of the monetary value of a discount code possible. Discount codes issued to customers are non-retailable and cannot be transferred. Discount codes are valid exclusively for the Swissmondue online shop. Validity: Discount codes are valid for a limited time. They expire on the date printed on the code. Extensions are not possible. Minimum order value: A minimum order value is always specified in the details of the respective discount code. If the minimum order value is subsequently undercut due to the return of the corresponding item, Snocks reserves the right to invoice the difference between the order with and without the discount code. Discount codes issued upon newsletter registration are valid for orders with a minimum value of CHF 19.99. Returns: If you exercise your right of withdrawal or return goods for any other reason, only the discounted purchase price will be refunded. There is no entitlement to a refund of the discount code or to a new discount code. Discounting for multiple items: If an order to which a discount code is applied consists of multiple items (shopping cart discount), Swissmondue reserves the right to distribute the discounted amount among one or several items. Non-fulfillment of an order or delivery: In the event of non-fulfillment of the order or individual items to which the discount code referred, there is no entitlement to a refund of the value of the discount code or to a new discount code. Discount codes via third-party providers: The redemption of discount codes, vouchers, or other bonus systems from third-party providers, such as Miles&More, PayPal, Payback, Otto.de, or Amazon, is not valid. We are not responsible for the accuracy or timeliness of offers or discount codes on third-party websites. 11.2 Snocks Gift Cards Usability: SWS Gift Cards can be purchased via the online shop. These have a value of CHF 25.00 or CHF 50.00, which can be selected before purchase. The gift cards are valid exclusively for the Swissmondue online shop. Validity: All SWS gift cards are valid for three years from the date of purchase. They can be redeemed for all products in the online shop. There is no minimum order value. Returns: The right of return remains unaffected. The stated terms and conditions apply. If a product is returned or refunded, the amount owed will be credited back to the gift card. Payment of the amount to a payment method other than the gift card is excluded. Return of the gift card/Snocks Gift Card: Returns, e.g., in the form of two CHF 25.00 gift cards, are excluded. Cash payment of the full or remaining amount is also not possible. 12. Liability: The above limitations and reductions of time limits do not apply to claims based on damages caused by us, our legal representatives, or vicarious agents. We are always liable without limitation in the following cases: in the event of injury to life, body, or health; in the event of intentional or grossly negligent breach of duty; in the event of a guarantee promise, insofar as agreed; or insofar as the scope of application of the Product Liability Act is applicable. In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on which the contractual partner may regularly rely (cardinal obligations), due to slight negligence on the part of us, our legal representatives, or vicarious agents, our liability is limited to the amount of the foreseeable damage typical for this type of contract at the time of its conclusion. Otherwise, claims for damages are excluded. 13.
